CONVICTION SURCHARGE FEE:

There is a conviction surcharge fee if you are convicted of any of the following in the preceding 36 months:  1) driving while license invalid 2) failure to maintain financial responsibility 3) no driver licenses offense 4) a driving while intoxicated offense as defined in Penal Code 49.09 or 5) moving traffic violations that result in the accumulation of six (6) or more points on you driving record.  Multiple convictions will result in multiple surcharge fees.

CONSUMER REGULATIONS:  EFFECTIVE MAY 5, 2004

Changes to the Consumer Regulations effect all movers.

1)    You must provide a written estimate, either binding or non-binding, to the shipper before the Order for Service is prepared.

2)    If you provide an estimate based on volume (by the cubic foot) that will later be converted to a weight-based rate, you must provide the shipper with an explanation of the conversion method that will be used to determine the charges.

3)    If you do not provide a binding estimate, you must provide a non-binding estimate.  You must furnish non-binding estimates without charge (free), ad they must be reasonably accurate.

4)    The maximum charge that you may collect at delivery is the amount of the binding estimate, or no more than 110% of the non-binding estimate amount, and you MUST defer billing for 30 days following delivery for:

        1)    Any added quantities or services not included on the estimate that are requested by the shipper when such services are supported by an addendum signed by the shipper,

    or

        2)    Any other additional services not requested by the shipper and not supported by a signed addendum (but necessary in the judgment of the carrier to accomplish delivery)

5)    You must provide a provision in your tariff (published in Exception Tariff 104) describing how your binding estimate item applies in order to enforce the provisions of the estimate.

6)    You must make sure that the estimate specifies the form of payment that will be honored at delivery; and the form of payment must agree with the form of payment that is specified on the Order For Service and the Bill of Lading.
